Privacy Policy

Eterna Films, a trade name of Eterna Creative Group Inc. ("Eterna Films," "the Studio," "we," "us," "our"), respects your privacy. This Privacy Policy explains what personal information we collect, why we collect it, how it is used, who we share it with, and the choices available to you. This Policy applies to eternafilms.ca (the "Website") and to any client gallery, file delivery platform, or online store we use to deliver your photos, videos, and related products (collectively, the "Delivery Platform"). We may use different delivery platforms for different projects or over time; this Policy applies regardless of which specific platform is used.

This Policy is intended to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario law.

1. Information we collect

We collect personal information in the following ways:

Information you provide directly:

• Through our contact form (eternafilms.ca/contact-us): first name, last name, phone number, email address, event date, service of interest, and any additional information you choose to share.

• Through your signed service agreement: your name, contact information, event details, and billing information.

• Through your Delivery Platform: your name, email address, and any information needed to process orders for digital downloads, prints, or other products, regardless of which platform is used to host or deliver your files.

Information collected automatically:

• Standard website usage data through cookies and similar technologies, including pages visited, browser type, device type, and general location (see Section 5, Cookies).

We do not knowingly collect sensitive personal information such as government identification numbers, health information, or financial account details directly; payment information is collected and processed by our third-party payment processors, as described in Section 3.

2. How we use your information

We use the personal information we collect to:

• Respond to inquiries submitted through our contact form and follow up regarding potential bookings

• Create and manage your service agreement, invoicing, and event scheduling

• Deliver your photos and videos through our Delivery Platform and process any digital download, print, or product orders you place

• Communicate with you about your booking, order, or delivery (including delivery updates and access expiry notices)

• Improve our Website and services, including through aggregated, non-identifying analytics

• Comply with legal, accounting, or regulatory requirements

We do not use your personal information for any purpose incompatible with the reasons it was collected, except with your consent or as permitted by law.

3. Who we share your information with

We do not sell your personal information. We share personal information only with the following categories of service providers, solely as necessary to deliver our services. The specific providers we use may change from time to time as our business and technology needs evolve; this Policy describes the categories of providers, rather than naming every individual platform, so that it remains accurate even as our tools change.

Delivery Platforms — used to host, deliver, and manage your photos and videos, and to process any digital download, print, or product orders you place. These platforms may store your name, email, and order details as necessary to fulfill these services. Examples of platforms we may use for this purpose include Pixieset and similar gallery or large-file delivery services; the specific platform used for your project will be communicated to you directly.

Print and production partners — engaged through our gallery platform or directly by us, to produce and ship any physical prints, albums, or products you order. These partners receive only the information necessary to fulfill your order, such as your shipping address and the images ordered.

Payment processors — to securely process payments for bookings, invoices, and Store purchases. We do not store your full payment card details ourselves; this is handled directly by our payment processors.

Customer relationship management (CRM), scheduling, and business communication software — used to manage inquiries submitted through our contact form, follow up on bookings, schedule services, and communicate with you about your project.

• Cloud storage and file transfer services — used to securely store, back up, or transfer your raw and edited files during production and delivery.

Professional advisors (such as our accountant or legal counsel), where necessary for legitimate business purposes, and always subject to confidentiality obligations.

Legal or regulatory authorities, where required by law, court order, or to protect our legal rights.

We require that any third party handling personal information on our behalf protect it in a manner consistent with this Policy and applicable law. We are not responsible for the independent privacy practices of these third parties beyond our agreements with them, and we encourage you to review the privacy policies of any specific platform used for your project, where applicable.

4. Data retention

We retain personal information collected through our contact form and customer management systems for as long as necessary to respond to your inquiry, manage an ongoing client relationship, or comply with legal, accounting, or tax obligations, after which it may be securely deleted or anonymized upon request, where we are not otherwise required to retain it.

Content and order information delivered through a Delivery Platform are retained in accordance with the terms of our Terms of Sale and Digital Image License, available on the platform used to deliver your files, which describe how long your content remains accessible and how that may change if we migrate to a different delivery platform.
